PRIVACY POLICY
This Privacy Policy (the “Privacy Policy“) describes the types of information Vital Spark Incorporated dba Momentous (“Momentous”) collects from you (“you” or “your“) when you access the Momentous website or register as an exhibitor or attendee at a Momentous exhibition (collectively the “Exhibition Program”). It also describes how Momentous uses and discloses such information, as well as your rights with respect to Momentous’ collection, use, and disclosure of such information.
By accessing and/or registering for any part of the Exhibition Program, you agree that Momentous may collect, use, and disclose Personal Data, Aggregate Information, and Cookies pursuant to this Privacy Policy.
Momentous may change or update the Privacy Policy from time to time by posting the revised version on the Momentous website. Therefore, you should periodically verify the date of this Privacy Policy to ensure that you are familiar with the most up-to-date version, as the most up-to-date version will govern your use of the Exhibition Program.
INFORMATION MOMENTOUS COLLECTS
When you access the Exhibition Program, Momentous may collect three types of information:
(1) Personal Data
Personal Data is any information directly or indirectly relating to an identified or identifiable individual, such as a name, an identification number, location data, an online identifier or one or more factors specific to that individual.
(2) Aggregate Information
Aggregate Information is information about your activities on or in connection with the Exhibition Program that typically cannot be used to identify, locate, or contact you. For example, Aggregate Information includes information regarding the frequency of use of the Exhibition Program, quantity and type of data entered when using the Exhibition Program, components of the Exhibition Program most frequently accessed, and browser types used to access the Exhibition Program.
(3) Cookies, etc.
Cookies, beacons, device identifiers, or similar technologies (referred to for convenience as “Cookies”) are small pieces of data placed on your device that your web browser or device uses to access the Exhibition Program and that permit Momentous to track your activity on the Exhibition Program. Momentous obtains information from Cookies when, for example, you visit the Momentous website. You may turn off cookies in your browser or device settings, but this may limit functionality of the Exhibition Program. Cookies help analyze usage and provide certain functionality. Cookies don’t contain Personal Data and for that reason, Momentous treats Cookies in the same manner as Momentous treats Aggregate Information. If Cookies do contain Personal Data, such Personal Data will only be used or disclosed in the same manner as other Personal Data pursuant to this Privacy Policy. Cookies cannot be used as a malicious tool.
COLLECTING PERSONAL DATA
Momentous collects Personal Data when:
(1) you register for and/or attend the Exhibition Program;
(2) you use certain features of the Exhibition Program that require the collection of Personal Data in order for those features to function;
(3) you voluntarily enter or upload Personal Data to or through the Exhibition Program; and
(4) you communicate with Momentous, whether through the Exhibition Program or through another form of communication, such as by e-mail or telephone.
COLLECTING AGGREGATE INFORMATION
Momentous collects Aggregate Information resulting from your use of the Exhibition Program.
USING AND SHARING PERSONAL DATA
Momentous uses Personal Data:
(1) to provide and promote the Exhibition Program;
(2) to improve the Exhibition Program;
(3) to communicate with you in response to any of your questions and requests; and
(4) to provide relevant marketing and other information to you, but only if, and to the extent that, you have consented to Momentous providing such marketing and other information to you in accordance with applicable laws. In such a case, Momentous will provide an easy link to permit you to “opt-out” of receiving future marketing communications.
In rare cases, Momentous may be required to share certain information with legal authorities. In such a case, Momentous will provide only the minimum amount of information required and, unless prohibited by law, Momentous will notify you of the Personal Data Momentous has provided.
Momentous may share Personal Data with third party service providers as Momentous deems necessary for such third party service providers to perform their duties required for the Exhibition Program to function. For example, the Exhibition Program may utilize payment processors, hosting providers and contract verifiers and processors. A list of third party service providers used by Momentous is available to you upon your request. These third party service providers are not authorized to retain, share, store or use Personal Data for any purposes other than to provide the services for which they have been retained to provide and/or through their own privacy policies.
Momentous does not sell or otherwise disseminate your Personal Data to third parties, except as set out in this Privacy Policy.
USING AND SHARING AGGREGATE INFORMATION
Momentous uses Aggregate Information:
(1) to provide the Exhibition Program;
(2) to improve the Exhibition Program;
(3) to monitor usage of the Exhibition Program;
(4) to analyze usage of the Exhibition Program;
(5) to research, compile, and report on usage trends, user demographics, and user behaviors; and
(6) for other legitimate business purposes.
Momentous may share Aggregate Information with its affiliates and certain third parties, such as third party service providers Momentous uses to provide the Exhibition Program.
Aggregate Information is anonymized and does not have the capacity to be used to identify an individual. In other words, Momentous may share this information, but no Personal Data will be disclosed to third parties.
LOCATION INFORMATION
Momentous may use the Exhibition Program to collect and use location information to provide certain functionality. All such information will be governed by this Privacy Policy.
EXTERNAL LINKS
When you click on links in the on-line store, if applicable, or through the Momentous website, they may direct you away from the Momentous website. Momentous is not responsible for the privacy practices of other sites and encourage you to read their respective privacy policies. Nonetheless, Momentous seeks to protect the integrity of the Momentous website and welcome any feedback about these sites.
THIRD PARTY LINKS
Momentous recommends reviewing the privacy policy of each third party site linked from this Site to determine it s use of your personal information.
TESTIMONIALS, PHOTOS AND VIDEOS
Momentous may choose to display personal testimonials relating to its exhibitions in addition to other endorsements. With your consent, Momentous may post your testimonial along with your name. If you wish to update or delete your testimonial, you may contact Momentous.
In addition, photos and videos are taken at Momentous events, which may feature attendees, speakers, sponsors or exhibitors. Where Momentous has taken photos and videos at Momentous events that feature you as an attendee, sponsor or exhibitor, to the extent permitted by applicable data protection laws, those photos and videos may be used for promotional purposes.
HOW DOES MOMENTOUS OBTAIN YOUR CONSENT?
By using the Exhibition Program, you are expressly consenting to Momentous collecting Personal Data and using it for the purposes as set out in this Privacy Policy.
If Momentous asks for your Personal Data for reasons such as marketing, Momentous will ask you for your consent. If, after you opt-in to using the Momentous website and provide Momentous with certain Personal Data, you change your mind, you may withdraw your consent at any time, by emailing Momentous at showinfo@MomentousExpo.com or mailing Momentous at: P.O. SECURITY AND DATA PROTECTION
Momentous takes appropriate security measures to protect Personal Data against unauthorized access, alteration, disclosure or destruction.
Such measures include internal reviews of Momentous’ data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where Personal Data is stored.
Momentous restricts access to Personal Data to Momentous’ contractors, employees, service providers and agents who need to know such information in order to operate, develop or improve the Exhibition Program. These individuals are bound by confidentiality obligations and are required to treat such Personal Data confidentially and in accordance with this Privacy Policy or their own privacy policies in the case of third party service providers.
DATA PROCESSING
Momentous processes Personal Data only for the purposes for which it was collected and in accordance with this Privacy Policy. Momentous takes reasonable steps to ensure that Personal Data Momentous processes is accurate, complete, and current.
Momentous may transfer your Personal Data to countries other than the one in which you live.
You have the right to access your Personal Data and require Momentous to update, delete or correct this information. The Exhibition Program permits you to update this information directly. Momentous will take all reasonable steps to update or correct Personal Data in Momentous’ possession.
FINANCIAL INFORMATION
Momentous or its third party processors may require certain financial information, such as credit card information. Momentous will not share this financial information, other than with the financial institutions involved in processing your payment. At all times, Momentous will comply in all respects with applicable consumer protection laws.
CHILDREN AND AGE OF CONSENT
By using the Momentous website, you represent that you are at least the age of majority in your jurisdiction of residence (and, in any case, you are at least 18 years old), or that you are the age of majority in your jurisdiction of residence and you have given Momentous your consent to allow any of your minor dependents to use the Momentous website.
Momentous does not knowingly collect or solicit Personal Data from anyone under the age of 18 or knowingly allow such persons to register. If Momentous becomes aware that it has collected Personal Data from a child under the relevant age without parental consent, Momentous will take steps to delete that information.
Canada’s anti-spam legislation (CASL)
The CASL is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
To be in accordance with CASL, Momentous agrees to the following:
• Not use false or misleading subjects or email addresses.
• Identify the message as an advertisement in some reasonable way.
• Include the physical address of the Momentous business or site headquarters.
• Honor opt-out/unsubscribe requests quickly.
• Allow users to unsubscribe by using the link at the bottom of each email
• If at any time you would like to unsubscribe from receiving future emails, you can follow the instructions at the bottom of each email and Momentous will promptly remove you from correspondence.
CHANGES TO THIS PRIVACY POLICY
Momentous reserves the right to modify, change or replace this Privacy Policy at any time for any reason without notice to you, so please take the time to review it frequently. Changes and clarifications will take effect immediately upon their posting on the Momentous website.
If Momentous is acquired or merged with another company, your information may be transferred to the new owners so that they may continue to offer or sell products to you under the Exhibition Program.
